What is Roundup?
Roundup, manufactured by Monsanto and Bayer, is one of the most popular herbicide brands in the world, used heavily as a weed killer in agriculture and farming, as well as lawns, gardens, and more. Monsanto’s Roundup herbicide is the most used weed-killer in the world. In fact, roughly half of Monsanto’s yearly revenue comes from their Roundup line of products, but the profitable herbicide comes with a dangerous price. That being, the main chemical ingredient in Roundup is glyphosate which scientific researchers have recently found to be a leading cause of cancer.
Roundup has been linked to lymphatic cancers like non-Hodgkin’s lymphoma, as well as certain forms of leukemia, among agricultural laborers and gardeners. Non-Hodgkin’s lymphoma is a rare cancer that affects the lymph nodes, the part of the body that produces white blood cells. Studies also link glyphosate to chromosomal damage in cells and the formation of tumors, as found in various animal studies. In addition, research findings also relate glyphosate to other cancers such as colon, kidney, liver, pancreatic, melanoma, and thyroid.
In 2015, the International Agency for Research on Cancer (IARC) published research data that classified glyphosate (the main chemical ingredient in Roundup) stating it as a “possible human carcinogen.” Their report concluded that glyphosate exposure is most commonly associated with non-Hodgkin lymphoma.
Since that data from the IARC became public knowledge, Monsanto and Bayer have faced (and are currently facing) thousands of lawsuits in federal and state courts over the herbicide. The first three cases that went to trial, the juries returned verdicts of $289 million, $80 million, and $2 billion against Monsanto. Following our wins in trial, out of fear of losing more trials and paying out hundreds of millions, if not billions, of dollars to the victims/plaintiffs, on June 24, 2020, Bayer agreed to pay over $10 Billion to settle thousands of Roundup cancer lawsuits across the country. Out of this total amount, $1.25 Billion will be set aside for those who may develop cancer in the future as a result of Roundup exposure. Though Bayer later increased this figure to $2 Billion, the judge still felt the amount wasn’t high enough, considering the potential number of current and future claimants, leaving this figure still up in the air for now.
As of the current date, while there are still Roundup trials being held, the majority of the cases filed against Monsanto are being settled without the need for trial, and the settlements have been quite substantial. Moreover, Monsanto has put up more money to settle these cases. As such, we at Torry Law Group are still accepting cases and filing Roundup lawsuits for those injured or killed from the potentially harmful product. We have been successful in past in settling this cases and are still actively seeking and receiving settlements for our clients.
To file a Roundup lawsuit, victims need to contact an experienced lawyer. Without help from reputable, experienced Roundup law firms, such as Torry Law Group, it can be almost impossible to take legal action, and even more difficult to obtain favorable results.
Filing and Settling a Roundup Lawsuit Consists of the Following Steps:
- Gathering Details: Our legal team will gather preliminary details of the victim’s Roundup exposure and medical history. Torry Law Group will obtain records and other evidence on a victim’s behalf in order to prove up this case.
- Build Support & Gather the Necessary Evidence: Further, our team will secure additional evidence, including your work history and medical records, needed to make sure there is no question or issue that victim qualifies for settlement.
- File a Lawsuit: Once our team has gathered all the evidence it needs linking a victim’s illness to Roundup and glyphosate, the lawsuit will be filed in the appropriate court system for the case.
- Settle: Our goal is to fiercely advocate for each and every one of our Roundup clients, and, most importantly, to obtain powerful results. While we are willing and capable of taking every case to trial, given our track record with Monsanto and Bayer, they do not want to try our Roundup cases, especially given their potential exposure to a huge verdict. Rather, they would rather settle. Thus, our goal is to settle these cases for the highest value possible, without having to litigate these cases for years on end.
Each step in this process, and especially when it comes to settlement, requires a skilled legal team. The Torry Law Group and the other lawyers we work on this litigation have decades of experience helping those injured by major corporations, just like the defendants in this case – Mansanto and Bayer – and we will make sure your Roundup lawsuit is correctly filed in a timely manner and settled or get a trial verdict for the highest value possible. No matter how hard the fight, we will not back down.
